Subscribers and their emergency contacts are required to recognize that Andrew Butchart / A. Butchart Consulting bears no liability in any failure of this service to operate as expected.

The Service relies entirely on email communications. We do not guarantee that emails will be delivered, free from delays, or bypass spam filters. The user is entirely responsible for monitoring their inbox, checking spam folders daily, and configuring their email client to accept communications from the Service.
NO EMERGENCY OR LIFESAVING SERVICES
THE SERVICE IS NOT AN EMERGENCY, RESCUE, LIFESAVING, OR MONITORING SERVICE. IT IS NOT A REPLACEMENT FOR EMERGENCY SERVICES, PROFESSIONAL CARE, OR REGULAR HUMAN CONTACT.
The Service operates solely as an automated, non-monitored email communication tool. You and your designated emergency contacts explicitly acknowledge and agree that: No Emergency Dispatch: The Company does not monitor responses in real-time, does not detect medical emergencies, and will never contact police, fire, ambulance, or emergency medical dispatchers under any circumstances. Email Delay Risks: Email delivery is inherently unreliable and may be delayed, blocked, or filtered into spam folders. The failure of an email to send, arrive, or be opened must never be relied upon to indicate that a user is safe or in distress. Sole Responsibility: Users and their contacts assume all responsibility for coordinating actual wellness checks and emergency assistance. In the event of a medical, mental health, or physical emergency, users or their contacts must call emergency services immediately. Complete Waiver: To the maximum extent permitted under the laws of Ontario, Canada, you release A. Butchart Consulting from any liability, injury, illness, loss of life, or damage resulting from a failure to deliver an email, a missed check-in, or any reliance placed on this Service for personal safety.
EMAIL TRANSMISSION AND DELIVERABILITY DISCLAIMER
THE SERVICE DEPENDS ENTIRELY ON THIRD-PARTY EMAIL NETWORKS, SERVERS, AND INTERNET SERVICE PROVIDERS (ISPs). THE COMPANY CANNOT AND DOES NOT GUARANTEE THAT ANY EMAIL WILL BE DELIVERED, ARRIVE ON TIME, OR BE READ BY THE INTENDED RECIPIENT.
By using the Service, you and your designated contacts explicitly acknowledge and agree to the following technical limitations: Spam and Junk Filters: Automated emails are frequently misidentified as spam, junk, or promotional marketing by email providers (such as Gmail, Outlook, Yahoo, and others). The Company is not responsible if system emails are filtered away from the main inbox. User Whitelisting Responsibility: It is your sole responsibility to configure your email settings—and ensure your emergency contacts configure theirs—to allow, trust, and whitelist emails from checkin@uncleandy.ca. ISP Throttling and Delays: External email servers may throttle, delay, or outright block automated messages due to local network traffic, system blacklists, or security updates beyond the Company's control. Delayed delivery shall not constitute a breach of service. Undeliverable Inboxes: The Company bears no liability for missed check-ins or failed alerts resulting from full recipient inboxes, deactivated email accounts, typos in the email addresses provided during registration, or local internet outages.
DATA PRIVACY AND PROTECTION
YOUR PRIVACY IS CRITICAL TO US. BECAUSE THE SERVICE PROCESSES PERSONAL HEALTH-ADJACENT AND CONTACT INFORMATION, WE ARE COMMITTED TO COMPLYING WITH CANADIAN PRIVACY PRINCIPLES UNDER PIPEDA AND ONTARIO LAW.
By creating an account and using the Service, you consent to the collection, use, and retention of your data as outlined below:
Information We Collect: We only collect information strictly necessary to operate the automated check-in system. This includes your name, email address, scheduled check-in times, and the names and email addresses of your designated emergency contacts. Consent for Contact Information: By providing the email addresses of third-party emergency contacts, you represent and warrant that you have obtained their explicit consent to share their information with us and to receive automated alert emails from the Service. How We Use Your Data: Your data is used exclusively to run the automated check-in schedules and send notification emails. We never sell, rent, trade, or share your personal data, or your contacts' data, with third-party marketers or external companies. Data Security: We implement standard technical safeguards to protect your data from unauthorized access or disclosure. However, no communication over the internet or email transmission is completely secure. We cannot guarantee absolute security of data transmitted to or from our platform. Complete Data Erasure upon Termination: If you choose to terminate your account, all personal data, contact schedules, and emergency contact details associated with your account will be permanently and completely deleted from our active database within 7 days. Privacy Inquiries: If you or your contacts have any questions regarding the handling of personal information, you may contact our privacy coordinator at checkin@uncleandy.ca.
Limitation of Liability
To the fullest extent permitted by law, A. Butchart Consulting shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario, Canada.
Changes to These Terms
We may update these Terms from time to time. We will notify you of changes by posting the new Terms on our website and updating the "Last Updated" date.
